B.J. Upton excited brother might become a Brave

ATLANTA (AP) - B.J. Upton is excited about the possibility of a family reunion in the Braves' outfield.

Upton signed a five-year, $75.25 million contract with Atlanta in November. After hearing the Braves may be pursuing a trade with Arizona for his younger brother, Justin Upton, B.J. said on his Twitter account:

"Wow these (at)JUS10UP10 rumors have me excited. Please don't tease me like this... Would be a dream come true if it happens."

Braves general manager Frank Wren said Wednesday the team has payroll flexibility to make another move. Wren would not say if the team is pursuing Justin Upton.

"We continue to monitor what's available on the market," Wren said. "If we feel like there's something that can help us and get us over the top, we're going to continue to explore. We have flexibility in talent and prospects if we get in a trade situation and we have financial flexibility to add payroll. If those opportunities present themselves, we'll be in the mix."

The Upton brothers and right fielder Jason Heyward would give the Braves one of baseball's best outfields. Heyward won his first Gold Glove in 2012, when he hit .269 with 27 homers and 82 RBIs.

Justin Upton, 25, had his best year in 2011, when he hit .289 with 31 homers and 88 RBIs and finished fourth in the MVP voting. He hit .280 with 17 homers, 67 RBIs and 18 stolen bases last season.

Martin Prado is expected to move from left field to third place to replace Chipper Jones, who has retired.

At his first news conference after signing with the Braves, B.J. Upton said he and his brother want to play in the same outfield.

"That's been a big, big topic of conversation," said B.J. Upton.

The Diamondbacks had agreed to a deal to trade Justin Upton to Seattle earlier this month but the player vetoed it. Seattle was among four teams that Upton's contract that he could nix. Atlanta is not on that list.

Upton has been the subject of trade speculation throughout the offseason. He is the most marketable of Arizona's glut of outfielders. The outfield became more crowded with the free agent signing of Cody Ross late last month.

Arizona also could clear room in the outfield by trading left fielder Jason Kubel, who reportedly has interest from Baltimore.

Justin Upton is due $38.5 million in the final three years of his contract, making him affordable under today's salary standards.

The Braves' current projected payroll is about $83 million - about $10 million less than last year.

Justin Upton's agent, Larry Reynolds, declined comment.

If the Braves don't add another outfielder, Juan Francisco could play third base against right-handers with Prado in left field. Francisco struggles against left-handers, so Prado could moving to third base against left-handers while Reed Johnson starting in left field.

Other options in the outfield include Jose Constanza and Jordan Schafer.

The most attractive option might be adding another Upton.

"If we can upgrade our offense then we're open to whatever," Wren said.

North Korea allows tourists to rent phones or SIM cards, but doesn't include internet

North Korea (which recently added Google's Eric Schmidt to its guest book) will begin loosening its restrictions on foreign cellphones, allowing any arrivals to either pick up a rental phone or SIM card from service provider Koryolink. With a rental booth already set up in Pyongyang airport, you'll be able to dial out to numbers abroad, foreign embassies and international hotels. However, the SIMs (priced at around $67) won't allow you to call locals, nor will they offer any internet data -- not even EDGE. Apparently, providing data to the rental SIMs in North Korea wouldn't be a technical issue, but dependent on whether it's granted approval by the DPRK government.

President Obama's inauguration will honor the memory of MLK ...

Washiongton -- Monday's inaugural may be President Barack Obama's big day, but Martin Luther King Jr. will loom large over the festivities. A quirk in the calendar pushed Obama's public swearing-in onto the national holiday honoring the slain civil rights leader, and inaugural planners have taken pains to acknowledge that fact. Going into his second term, Obama seems to have put King at the front of his mind, too.

The president has referenced King in speeches, and the weekend of inaugural festivities opened Saturday with a national day of service in King's honor. Obama and his family also helped spruce up an elementary school in southeast Washington. The Obamas have performed community service work on the King holiday in each of the past four years.

Obama spoke at the 2011 dedication of a monument to King on the National Mall and is likely to include King in his inaugural address.

The president has said King is one of two people he admires "more than anybody in American history." President Abraham Lincoln is the other. In a nod to that admiration, Obama will take his ceremonial oath of office Monday using Bibles owned by both men. Lincoln's Bible, which Obama also used in 2009, will rest on top of King's, which is larger.

"The movements they represent are the only reason that it's possible for me to be inaugurated," Obama said in a video released by inaugural planners.

Obama is perhaps the most high-profile product of King's quest for civil rights and racial equality in the U.S. He credits King for his own political victories, particularly the 2008 election win that lifted him over the highest hurdle for minorities in American politics.

Even with that, there are distinctions in their styles. While King was a staunch advocate for the poor and downtrodden, Obama has been faulted by critics who say he's been reluctant to push issues of concern to black people and take steps to reduce high rates of black unemployment. Where King opposed wars in general and was an unwavering advocate of nonviolence, Obama has shown himself to be willing to target and kill leaders of terrorist groups overseas.

Fredrick Harris, director of Columbia University's Center on African-American Politics and Society, argues that Obama's reluctance to bring black issues to the forefront undermines the work of King and other civil rights leaders whose efforts made his presidency possible.

"Dr. King died in 1968 fighting for low-wage garbage workers in Memphis, Tenn. He was starting a national poor people's movement to address the issues of poverty," Harris said. "With the president, a Democratic president for that matter, who has spoken less on race or the poor or poverty than any Democratic president in a generation, it is problematic when we think of that aspect of King's legacy."

On at least one foreign policy issue, the Middle East, Obama and King seem to be in accord. Lewis V. Baldwin, a religious studies professor at Vanderbilt University, writes in a new book that Obama's approach to Israeli security and empowering the Palestinians dovetails with King's thoughts on the matter.

On the jacket of Baldwin's book, "In a Single Garment of Destiny," Obama explained his take on King's idealism.

"When met with hardship, when confronting disappointment, Dr. King refused to accept what he called the 'isness' of today. He kept pushing for the 'oughtness' of tomorrow," Obama wrote.

Obama recognizes his role in U.S., and even world, history and how he has benefited from the work of King and other civil rights advocates. During his presidency, he has paid regular tribute to King, who was assassinated in April 1968 in Memphis, Tenn., when Obama was just 6 years old. American's first black president will deliver his second inaugural address looking out across the National Mall toward the Lincoln Memorial, where King delivered his "I Have a Dream" speech nearly 50 years ago.

One of eight floats scheduled to participate in the parade down Pennsylvania Avenue between the Capitol and the White House will honor King, featuring his image and a representation of his quote "out of the mountain of despair a stone of hope."

Rep. John Lewis, D-Ga., a veteran of the civil rights movement who knew King and knows Obama, said the symbolism is overwhelming.

"It is almost too much to believe that we would commemorate this year, the 150th anniversary of the Emancipation Proclamation, the 50th anniversary of the march on Washington," Lewis said. "I don't know what you'd call it, something about time and history and fate all coming together."

Lincoln issued the proclamation on Jan. 1, 1863, during the Civil War, declaring all slaves in states rebelling against the Union to be "forever free."

Vicki Crawford, director of Morehouse College's Martin Luther King Jr. Collection, said the inauguration falling in a year of civil rights milestones is a prime opportunity for the nation to re-examine its past and look ahead to the future.

"Obama is a part of the continuum of a history that began before Dr. Martin Luther King," she said. "It's a long history of struggle to make America the place it should be to make real on the promise of democracy. This is a momentous time; 2013 is a crossroads."

Harris, the Columbia University professor, said that while King's moment in 1963 and Obama's in 2013 are evidence of how far the country has come despite persistent racial polarization, he would like to see Obama start to emphasize issues that were important to King.

"I would also hope that this won't be just a day of recognition but also that it will point in some direction in the second term that the president will begin to speak much more clearly and forcefully about the persistence of racial inequality in American life," he said.

Djokovic plays another Australian Open marathon

MELBOURNE, Australia (AP) ? The opponent was different, the match three rounds earlier. Still, the result gave Novak Djokovic a familiar feeling, and another chance to rip off his shirt in celebration.

Djokovic needed just over 5 hours to beat Stanislas Wawrinka 1-6, 7-5, 6-4, 6-7 (5), 12-10 in a fourth-round match Sunday night at the Australian Open, on the same court where he needed 5:53 to beat Rafael Nadal in last year's final.

"I just had flashback of 2012," Djokovic said. "It was maybe 45 minutes less this match than the one 12 months ago, but still it was still as exciting. I tried to enjoy the moment and couldn't ask for more. What a match point ... unbelievable."

He wasn't exaggerating about the match point. On his third attempt to end it, his backhand cross-court shot zipped past the valiant Wawrinka, who, Djokovic conceded, had outplayed him for most of the night.

"He came up with great tactics today," Djokovic said. "He didn't give me a lot of the same rhythm that I could get into the match. He was the one being in charge. I was passive. "

The win was Djokovic's 18th in a row at Melbourne Park after winning the last two Australian titles and advanced the Serbian star to the quarterfinals of his 15th consecutive major tournament.

Wawrinka, who had been receiving treatment to his upper leg muscles from late in the fourth set, said he would take more positives than negatives out of the match. He led 5-2 in the second set after outplaying Djokovic in the first.

"For sure, I think the best match I have ever played," Wawrinka said. "I fought like a dog like always. At 4-4 in the final set, I thought I might have won the match, but he was just better."

Djokovic will next play No. 5 Tomas Berdych, who needed five match points in the tiebreaker before beating South Africa's Kevin Anderson 6-3, 6-2, 7-6 (13).

Fourth-seeded David Ferrer won 6-2, 6-1, 6-4 over No. 16 Kei Nishikori of Japan to set up a quarterfinal against fellow Spaniard Nicolas Almagro, who was leading 6-2, 5-1 when No. 8 Janko Tipsaveric retired from their fourth-round match.

The Djokovic-Wawrinka match overshadowed Maria Sharapova's accomplishment earlier in the day.

Sharapova advanced to the quarterfinals with a 6-1, 6-0 win over Kirsten Flipkens in another impressive display ? last year's French Open champion has lost just five games through four rounds, breaking the Australian Open mark of eight held previously by eventual champions Steffi Graf and Monica Seles.

"A couple that I've won, I felt like I was playing great from the beginning and I was able to carry that through the whole tournament," said Sharapova, who won titles in 2004 at Wimbledon, 2006 at the U.S. Open and 2008 in Australia before completing her career Grand Slam with a victory at last year's French Open.

She can't remember ever winning so few games through four rounds of a tournament, but realizes this means nothing if she doesn't make it to the latter stages.

"Well, I'm certainly happy to be playing this well but ... it only gets tougher from here," said Sharapova, who is playing her first tournament of 2013 after withdrawing from a warm-up event at Brisbane because of an injured right collarbone.

She next plays fellow Russian Ekaterina Makarova, who beat fifth-seeded Angelique Kerber 7-5, 6-4. Sharapova defeated Makarova in the quarterfinals here last year on her way to the final, which she lost in straight sets to Victoria Azarenka.

Li Na, who reached the final here in 2011 and won the French Open later that year, saved a set point in the tiebreaker before beating Julia Goerges 7-6 (6), 6-1. She'll play No. 4 Agnieszka Radwanska, who beat No. 13 Ana Ivanovic 6-2, 6-4 for her 13th consecutive win. Radwanska won the Auckland and Sydney titles before coming to Melbourne.

On Monday, Roger Federer plays Milos Raonic, and U.S. Open champion Andy Murray faces Gilles Simon. Azarenka, Serena Williams and fellow American Sloane Stephens also have their fourth-round matches.

Thy will have a tough time matching the spectacle of Sunday's late-night encounter.

Djokovic had beaten Wawrinka ? the perennial No. 2 among Swiss tennis players to 17-time major winner Roger Federer ? in their 10 previous matches. He hadn't lost a head-to-head since 2006 and had won 11 straight sets between them.

Wawrinka stunned the top-ranked Djokovic with three service breaks in the first set and had that 5-2 lead in the second before the 25-year-old Serb rallied by winning six consecutive games. But just as Djokovic seemed to be taking control, Wawrinka launched his own comeback to win a long tiebreaker and force a fifth set.

Djokovic got to serve first in the fifth, giving him a psychological edge as long as he held his serve.

Wawrinka had game point in the 22nd game but let Djokovic get on a roll. He saved his first match point with a service winner, then saved another two minutes later.

At 1:40 a.m. local time, Wawrinka was whacking his head with the racket and biting the ball after giving Djokovic another match point.

Moments later, he was slumped on the court, exhausted. Djokovic raised both arms, walked to the net and embraced his beaten rival, then pulled of his shirt and flexed.

"Give him credit, he made me run all over the court," Djokovic said. "He never gave me the same ball. He was aggressive from both sides. I didn't know what was coming next."

Standard written checklists can improve patient safety during surgical crises

Jan. 18, 2013 ? When doctors, nurses and other hospital operating room staff follow a written safety checklist to respond when a patient experiences cardiac arrest, severe allergic reaction, bleeding followed by an irregular heart beat or other crisis during surgery, they are nearly 75 percent less likely to miss a critical clinical step, according to a new study funded by the U.S. Department of Health and Human Services' Agency for Healthcare Research and Quality.

While the use of checklists is rapidly becoming a standard of surgical care, the impact of using them during a surgical crisis has been largely untested, according to the study published in the January 17 online and print issue of the New England Journal of Medicine.

"We know that checklists work to improve safety during routine surgery," said AHRQ Director Carolyn M. Clancy, M.D. "Now, we have compelling evidence that checklists also can help surgical teams perform better during surgical emergencies."

Surgical crises are high-risk events that can be life threatening if clinical teams do not respond appropriately. Failure to rescue surgical patients who experience life-threatening complications has been recognized as the biggest source of variability in surgical death rates among hospitals, the study authors noted.

For this randomized controlled trial, investigators simulated multiple operating room crises and assessed the ability of 17 operating room teams from three Boston area hospitals -- one teaching hospital and two community hospitals -- to adhere to life-saving steps for each simulated crisis.

In half of the crisis scenarios, operating room teams were provided with evidence-based, written checklists. In the other half of crisis scenarios, the teams worked from memory alone. When a checklist was used during a surgical crisis, teams were able to reduce the chances of missing a life-saving step, such as calling for help within 1 minute of a patient experiencing abnormal heart rhythm, by nearly 75 percent, the researchers said.

Examples of simulated surgical emergencies used in the study were air embolism (gas bubbles in the bloodstream), severe allergic reaction, irregular heart rhythms associated with bleeding, or an unexplained drop in blood pressure.

Each surgical team consisted of anesthesia staff, operating room nurses, surgical technologists and a mock surgeon or practicing surgeon.

"For decades, we in surgery have believed that surgical crisis situations are too complex for simple checklists to be helpful. This work shows that assumption is wrong," said Atul Gawande, M.D., senior author of the paper, a surgeon at Brigham and Women's Hospital and professor at the Harvard School of Public Health. "Four years ago, we showed that completing a routine checklist before surgery can substantially reduce the likelihood of a major complication. This new work shows that use of a set of carefully crafted checklists during an operating room crisis also has the potential to markedly improve care and safety."

Hospital staff who participated in the study said the checklists were easy to use, helped them feel more prepared, and that they would use the checklists during actual surgical emergencies. In addition, 97 percent of participants said they would want checklists to be used for them if a crisis occurred during their own surgery.

The practice of using checklists is borrowed from high-risk industries such as aviation and nuclear power, where checklists have been tested in simulated settings and shown to improve performance during unpredictable crisis events.

A team of physicists from the Institut Non Linéaire de Nice have discovered how to produce a laser from a cloud of gas for the first time. Normally, Lasers amplify light by bouncing it around inside a confined space like a crystal, simulating the emission of radiation. While the phenomenon has been found on other planets, reproducing the effect on Earth has been difficult, because gas is less ordered and refined than your average crystal. The team succeeded by using a cloud of rubidium in a magneto-optical trap, and the discovery should help scientists understand more about gas lasers and help them to discover new forms of artificial light.

Why trees can't grow taller than 100 metres

TYPICALLY, the taller the tree, the smaller its leaves. The mathematical explanation for this phenomenon, it turns out, also sets a limit on how tall trees can grow.

Kaare Jensen of Harvard University and Maciej Zwieniecki of the University of California, Davis, compared 1925 tree species, with leaves ranging from a few millimetres to over 1 metre long, and found that leaf size varied most in relatively short trees.

Jensen thinks the explanation lies in the plant's circulatory system. Sugars produced in leaves diffuse through a network of tube-shaped cells called the phloem. Sugars accelerate as they move, so the bigger the leaves the faster they reach the rest of the plant. But the phloem in stems, branches and the trunk acts as a bottleneck. There comes a point when it becomes a waste of energy for leaves to grow any bigger. Tall trees hit this limit when their leaves are still small, because sugars have to move through so much trunk to get to the roots, creating a bigger bottleneck.

Jensen's equations describing the relationship show that as trees get taller, unusually large or small leaves both cease to be viable (Physical Review Letters, doi.org/j6n). The range of leaf sizes narrows and at around 100 m tall, the upper limit matches the lower limit. Above that, it seems, trees can't build a viable leaf. Which could explain why California's tallest redwoods max out at 115.6 m.

Oosthuizen clinches Volvo Golf Champions by a shot

World No. 6 Louis Oosthuizen fired a six-under-par 66 to overhaul third-round leader Scott Jamieson and clinch the Volvo Golf Champions by one shot on Sunday, a victory that will move him to fourth in the rankings.

Jamieson had held a five-stroke advantage after 54 holes, but seven birdies from the 2010 British Open champion Oosthuizen gave him a sixth European Tour win on 16-under 272 ahead of Briton Jamieson (72), who nearly holed a chip at the 18th to force a playoff.

Thailand?s Thongchai Jaidee (68) sealed third place a shot further back, while triple major winner Padraig Harrington (68) finished fourth on 12-under.

Oosthuizen, who on Saturday surrendered the lead as he struggled to a 74, birdied two of the first three holes to put the pressure on Jamieson.

Further birdies at the sixth and eighth holes rounded off an outward nine of 32 and he had reduced the deficit to one by the turn.

Birdies at the 10th and 11th holes propelled him into the lead, and despite bogeying the par-four 16th after finding the greenside bunker, Oosthuizen?s two-putt pars at the 17th and 18th holes were enough to clinch victory.

?I played the complete opposite of what I did yesterday [Saturday],? the 30-year-old, who was to move to a career-high fourth place in the rankings released yesterday, told reporters. ?Yesterday I felt really uncomfortable ? my swing felt long and unstable. This morning I worked on a few things on the range and put my head down. I knew if I could just put a score up there, or just get close to Scott, that I had a good chance.?

Oosthuizen, who has now recorded a win in the last three seasons in his native South Africa, said his ambition was to climb even higher in the rankings although world No. 1 Rory McIlroy was a little far off.

?Top spot is a tough one. I think Rory [McIlroy] is far ahead, so if I can somehow get myself to number two then I can work on trying to get to number one,? he said.

Scot Jamieson, who won his maiden European Tour title at the inaugural Nelson Mandela Championship in Durban five weeks ago, nearly forced a playoff when his eagle chip at the short par-four 18th finished inches from the cup.

?I almost had a grand-stand finish at the end there,? the world No. 100 told reporters after a frustrating day where he managed just three birdies, a double-bogey on the front nine proving costly.

The Atmospheric Infrared Sounder instrument that flies on NASA's Aqua satellite provides valuable data to tropical cyclone forecasters, and revealed sinking air, a small area of powerful thunderstorms, and a slightly elongated Tropical Storm Emang.

Infrared data on Tropical Storm Emang's cloud top temperatures was captured by the Atmospheric Infrared Sounder (AIRS) instrument on Jan. 15 at 0823 UTC (3:23 a.m. EST). AIRS data showed that the largest area of powerful thunderstorms were in the northern half of the storm. That area showed cold cloud top temperatures of -63F (-52C) indicating high, powerful thunderstorms where the heaviest rain was falling.

The AIRS data also showed that sinking air or subsidence was occurring in the southwestern quadrant of the storm, which is weakening the convection there.

AIRS data also showed that the low level center of circulation had become slightly elongated, stretching from southwest to northeast. For a tropical cyclone to intensify, its circulation centers from the surface to upper atmosphere basically have to stack up. When the center becomes elongated the storm usually has a difficult time intensifying.

On Jan. 15 at 0900 UTC, Tropical Storm Emang's maximum sustained winds were near 35 knots (40.2 mph/64.8 kph). Emang is moving slowly to the south-southwest at 4 knots (4.6 mph/7.4 kph). Emang was centered near 13.5 south latitude and 78.6 east longitude, about 525 nautical miles (604.2 miles/ 972.3 km) southeast of Diego Garcia. Diego Garcia is a coral atoll in the central southern Indian Ocean.

Forecasters at the Joint Typhoon Warning Center expect atmospheric conditions to improve over the coming days, so that Emang can organize and strengthen. Fortunately, the storm is no threat to land.

18 human heads, shipped from Rome, stuck at O'Hare

Authorities at Chicago's O'Hare International Airport are holding up a shipment of 18 human heads meant to be used in anatomical research at a facility in the Chicago suburbs, local media reported.

The heads arrived from Rome just before Christmas, and officials initially said an issue with paperwork caused the hold-up, according to the Chicago Sun-Times. But the newspaper reported Tuesday that authorities stopped the shipment from going through because it was headed to a facility that is under investigation.

According to an anonymous source quoted by the Sun-Times, the investigation itself is ?absolutely not? connected to the shipment of the heads.

A spokeswoman for the Cook County Medical Examiner's Office, Mary Paleologos, told The Associated Press the heads were now being held in containers at the Cook County morgue.

The heads, shipped from a legitimate facility in Italy, were properly embalmed, wrapped and tagged as human specimens, Paleologos told the AP. There is no suggestion of foul play, she added.

The heads, still covered in skin, were found Monday at the airport.

?There?s no issue with the transportation of body parts for medical purposes,? Brian Bell, a?spokesman with the U.S. Department of Homeland Security, told the Sun-times. ?There?s nothing against the law that says you cannot ship them, provided you have the right documentation.

?Everybody here is ?Oh my gosh, you got a box of heads? and everybody thinks that it?s unheard of,? Bell added. ?It is a potentially legitimate medical shipment. We?ve seen it at various ports in the nation.?

David Rutkauskas, Beautiful Brands Sued by Master Franchisee

David Rutkauskas, founder and CEO of Beautiful Brands International (BBI), is being sued by Emirates Associated Business Group (EABG), an Abu Dhabi Corporation.

Also named in the suit are:

-? Beautiful Brands International, LLC

-? Dixie Cream Donuts Franchise Systems, LLC

-? Daylight Donut Flour Company, LLC

-? Freshberry Franchise Systems, LLC

-? Camille?s Franchise System, LLC

-? Blazing Onion Franchising, LLC

The suit was filed September 28, 2012 in the Superior Court of Washington for Snohomish County by Howard Morrill & James Jackson of Simburg,? Ketter, Sheppard & Purdy, LLP, the attorneys for the Plaintiff.

The lawsuit alleges that on or about December 27, 2010, EABG entered in a Master Franchise agreement for the United Arab Emirates (UAE), Qatar, Iraq, Jordan, Turkey, Bahrain, Lebanon and Syria.

EABG alleges it paid an initial fee of $500,000 for the right to develop Dixie Cream Donuts and other BBI-owned and BBI partner brand franchises in the Middle East.

The complaint against David Rutkauskas and BBI states ?the Agreement explicitly conveys the rights to develop eight additional ?Dixie Cream Donuts/Beautiful Brands International franchise brands.?

Those brands include:

  • Rex?s Chicken
  • FreshBerry
  • Greenz Salads
  • In The Raw Sushi
  • Le Beau Rouleau
  • Camille?s Sidewalk Caf?
  • Blazing Onion Burger Company
  • Top That Pizza

The suit alleges that EABG was not provided with a Uniform Franchise Offering Circular (UFOC) or a Franchise Disclosure Document (FDD) in connection with its purchase of the franchise rights of the named brands.

The lawsuit against Mr. Rutkauskas & BBI states:

EABG has learned that a third party has been sold franchise rights by Beautiful Brands that conflict with rights purportedly conveyed to EABG under the Agreement.

Beautiful Brands has disavowed material terms of the Agreement and has demanded additional compensation as a condition of fulfilling its obligations?

The foregoing acts and omissions of Dixie Cream, Beautiful Brands and Mr. Rutkauskas constitute actual or anticipatory breaches of the Agreement?

The foregoing acts and omissions constitute violations of the Oklahoma Business Opportunity Sales Act, the Washington Franchise Investment Protection Act and/or the Federal Trade Commission Franchise Rule?

The EABG lawsuit seeks rescission of the master franchise agreement, an award of EABG?s damages, an award of EABG?s costs and attorneys? fees, and ?additional relief as the Court deems just and equitable.?

Old enough to enjoy a glamorous 3-hour awards show without squirming. Old enough to "get" all the jokes in the monologue. Old enough to sip champagne at a table full of stars. Old enough to be mistaken as her father's romantic partner all night.

Denzel Washington made the sweet decision to bring his 21-year-old daughter, Olivia, to the Golden Globes as his date last night, then spent the entire evening explaining to people that, no, she was not his 62-year-old wife, Pauletta.

"IT'S NOT MY WIFE, PAULETTA," he warned Ryan Seacrest, before the used car salesman to the stars had even finished greeting him.

"Denzel's wife looks bored," observed Twitter.

"An earlier version of the caption with this photo incorrectly identified Denzel Washington's daughter as his wife," apologized The New York Times, "and misspelled Mr. Washington's surname." (How? Washingtonn? Ouashington?)

Luckily, Olivia seemed to take it in stride, giggling good naturedly as her father explained to Ryan Seacrest that she was not a person he had ever had sex with.

Just classic dad stuff.

WASHINGTON (AP) ? An Education Department official says Secretary Arne Duncan will remain in President Barack Obama's Cabinet into a second term.

The official disclosed the decision Monday on the condition of anonymity because a public announcement has not been made.

Duncan, a former head of Chicago public schools, was widely expected to stick around. He is a former college basketball player who often joins Obama on the court.

During his first term, Duncan put in place the Race to the Top program that encouraged schools to compete for education dollars. Duncan's department also gave most states exemptions to the No Child Left Behind law when it became clear that they would not be able to meet the requirement that all students be proficient at grade level in math and reading by 2014.

Oakland: Shootings have residents 'living in fear'

In the two weeks since the start of the new year, Oakland, Calif. has already registered six homicides.

The city has been in chaos for the last several weeks as rival gangs have been shooting at each other. Over the weekend, 11 people were shot. On Friday, four people were killed within six hours. On Sunday, five people survived gunshot wounds.?

City leaders on Monday decried the gun violence that has rung out across the city in recent weeks. But Police Chief Howard Jordan stopped short of formally requesting that Oakland be put in a ?state of emergency,? saying that the police department is already operating as though it is.


Jordan spoke after returning from the scenes of two recent homicides in neighborhoods where he said people are living in "fear and helplessness."

Last year there were 131 homicides, the most since 2006, when there were 148.

Fifteen deputies from the Alameda County Sheriff's Department area already are working with Oakland Police, as is the U.S. Marshal Service, the California Highway Patrol and religious ministers. The city has asked the Bureau of Alcohol, Tobacco, Firearms and Explosives to track down some of the guns.

A state of emergency is a government declaration that can free up money and potentially suspend rights and freedoms of residents, depending on the situation.

In this case, however, Chief Jordan said that putting Oakland into a formal state of emergency, would only result in just seven days of help. That would be a short-term fix, he said.

Vice Mayor Larry Reid told the?Bay Area News Group?this weekend: "We've lost control. It's time for us to declare a state of emergency."

On Monday, City Councilman Noel Gallo told NBC Bay Area that he supports "any tool that helps our police chief."?

Gallo added: "We've got to reestablish order."

In a statement, Oakland police said its department is "actively and aggressively investigating the four homicides on Friday.? The department said it has determined that the violence is related to ongoing feuds between several groups.

The Oakland Tribune reported that the rivalry is over a woman.

Here is what is known about Friday's homicides:

  • According to police, a 22-year-old Oakland man shot and killed around 2:30 p.m. Friday in the 2300 block of East 17th Street in the Fruitvale District. His name is being withheld pending notification of relatives.
  • Around 3 p.m., another man was shot and killed on Canon Avenue near Wellington Street, next to Dimond Park.?He was identified as 30-year-old former Oakland resident Larry Lovette of Stockton.
  • At 4:15 p.m., 21-year-old Oakland man Eddiebo Rodriguez was fatally shot in the 3400 block of West Street in West Oakland. He later died at the hospital.
  • In East Oakland, a 17-year-old boy identified as Ken Harbin of Oakland was also fatally shot in the 9400 block of Hillside Street.
